The Department of Telecommunications (DoT) has issued a strong advisory reminding mobile users that they can be held legally accountable if SIM cards registered in their name are used for cyber fraud, impersonation, or any unlawful activity. The directive is part of the government’s broader push to clamp down on telecom-enabled financial crime and identity misuse.
Subscribers Now Directly Responsible for SIM Safety
In its statement, the DoT stressed that individuals must safeguard their SIM cards and mobile devices. Any illegal activity traced back to a subscriber’s credentials can invite legal action under the Telecommunications Act, 2023 — even if the misuse was carried out by someone else.

The advisory lists high-risk practices that users must avoid. These include operating mobile phones with tampered or duplicated IMEI numbers, using illegally assembled devices such as SIM boxes or modems, and obtaining SIMs through fake documents or impersonation.
Handing Over SIM Cards Could Land Users in Trouble
The DoT has made it clear that SIM cards should never be given to third parties. If a SIM issued in someone’s name is used for wrongdoing, the registered subscriber may be treated as the offender under applicable laws.
Strict Penalties Under the Telecommunications Act, 2023
The Telecommunications Act, 2023 introduces stringent penalties for tampering with telecom identifiers such as IMEI numbers — crucial for verifying a device’s lawful identity. Offences can lead to imprisonment of up to three years, fines of up to ₹50 lakh, or both.

Further strengthening the enforcement framework, the Telecommunications (Telecom Cyber Security) Rules, 2024 prohibit the alteration, possession, or use of equipment that enables IMEI modification.
Sanchar Saathi: Tools to Help Users Stay Secure
To support users, the government’s Sanchar Saathi platform offers digital tools to verify devices and mobile connections. Through the portal or mobile app, citizens can check a device’s IMEI status, confirm manufacturer details, and review all active mobile numbers linked to their ID.
The platform helps prevent unauthorised connections, identity theft, and device misuse. It also includes real-time reporting for lost or stolen phones, adding another layer of security to India’s digital communication ecosystem.
